Welcome to TornadoTitans.com (“TornadoTitans,” “we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your access to and use of TornadoTitans.com, TitanTrack, Titan U, and the related public-facing tools, maps, forecasts, educational content, and share features we make available (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Educational and supplemental weather information only
The Services are designed to support weather education and to provide supplemental informational tools. They are not an official source of weather warnings, emergency information, or safety instructions.
Weather conditions can change quickly. Do not make safety, travel, shelter, medical, emergency, or property-protection decisions based solely on the Services. Always use official sources, including the National Weather Service, local emergency-management authorities, and local broadcast information, and follow all official warnings and instructions.
We do not guarantee that information in the Services is complete, current, accurate, uninterrupted, available for a particular location, or suitable for your particular purpose.
2. Eligibility and acceptable use
The Services are intended for a general audience and are not directed to children under 13. If you are under 13, do not use the Services. If you are under the age of majority where you live, use the Services only with the permission and supervision of a parent or legal guardian.
You may use the Services for lawful personal, educational, editorial, and commercial purposes, subject to these Terms. You agree not to:
- use the Services unlawfully or in a way that could harm people or property;
- interfere with, disrupt, overload, probe, or attempt to bypass the Services or their security measures;
- use automated tools to scrape, harvest, or make excessive requests to the Services without our written permission;
- remove, obscure, or alter copyright notices, watermarks, branding, or source attributions; or
- misrepresent TornadoTitans content as your own or imply our endorsement of you or your work.
3. Sharing TornadoTitans content
Sharing TornadoTitans content is free and encouraged, including in commercial contexts, provided you comply with this section.
When sharing a graphic created with a TornadoTitans share feature, you must either:
- keep the TornadoTitans.com watermark visible and unaltered; or
- directly credit TornadoTitans.com in the post with a tag or a link to TornadoTitans.com.
This credit requirement applies in every context and without exception. You may not crop, cover, remove, or alter a watermark in a manner that eliminates the required attribution unless you provide the direct tag or link described above.
4. Intellectual property
The Services, including their design, software, branding, original graphics, text, educational materials, compilations, and other original content, are owned by TornadoTitans.com or its licensors and are protected by applicable intellectual-property laws.
These Terms do not transfer ownership of any TornadoTitans intellectual property to you. They also do not limit any rights you may have in public-domain materials, third-party materials, or factual weather information. Some data, maps, video, and other materials displayed through the Services may be subject to separate terms or attributions from their respective providers.
5. Third-party services and content
The Services may display or link to material from third parties, including weather-data providers, mapping providers, video platforms, and advertisers. Those materials and services are controlled by their providers, not TornadoTitans. We are not responsible for third-party content, availability, privacy practices, or terms.
6. No warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TORNADOTITANS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TORNADOTITANS.COM AND ITS OWNERS, CONTRIBUTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING LOSSES RELATED TO WEATHER CONDITIONS, EMERGENCIES, TRAVEL, OR RELIANCE ON INFORMATION IN THE SERVICES.
Nothing in these Terms limits liability that cannot lawfully be limited.
8. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless TornadoTitans.com and its owners, contributors, and service providers from claims, damages, losses, and expenses arising from your violation of these Terms or your unlawful use of the Services.
9. Changes to the Services or these Terms
We may modify, suspend, or discontinue any part of the Services at any time. We may also revise these Terms from time to time. The updated Terms will be posted on this page with a revised effective date. Your continued use after an update means you accept the updated Terms.
10. Governing law and venue
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services must be brought exclusively in the state or federal courts located in New Mexico, and you consent to the jurisdiction and venue of those courts.
